Q: Can a Board of Commissioners discuss their concerns about or the potential discipline of another Board member behind closed doors?

A: No. The Sunshine Act contains a “personnel exception” which allows agency members to meet behind closed doors to discuss specific employees and appointees of the agency. Board members are elected officials and do not qualify as “employees” or “appointees” under this executive session exception.
