Q: Can an apartment ad say “no smoking, no illegal drugs”?
A: Yes. Smokers and illegal drug users are not “protected classes” under the Pennsylvania Human Relations Act. As always, though, it is better to describe the activity and not the individual (the Human Relations Commission advises against language that refers to the type of tenant wanted, e.g., “no smokers, no drug users”).
