Q: Can a public agency limit public comment to residents or taxpayers?

A: The Sunshine Act requires public agencies to allow taxpayers or residents or both to speak at public meetings. Although the Sunshine Act would permit an agency to limit public comment to these groups, the PNA discourages the adoption of such a policy, because it would be impractical to enforce and would almost always raise issues about discriminatory enforcement.
