Q: With hunting season quickly approaching, our newspaper is routinely getting ads for gun sales. Can we run those types of ads?

A: Yes, but gun sale ads do carry some risk.

Newspapers should be aware that gun sale ads may not be directed at minors or others who cannot legally own, sell or possess guns in Pennsylvania such as those who have been convicted of a serious criminal offense.

Newspapers should also be aware that victims of gun related accidents or crimes might attempt to hold the publisher of the ad liable. The trend in those cases has been to find newspapers not liable but the fact that lawsuits have been filed means there is some risk in accepting gun sale ads.

Newspapers should avoid any advertising that may have the effect or perceived effect of providing access to firearms to minors or dangerous persons.
