Member Alert: Advertising alcoholic beverages in
Pennsylvania
Pennsylvania bars and restaurants (and other entities holding alcoholic
beverage licenses in the Commonwealth) are required to follow the Liquor
Code and the corresponding regulations of the Pennsylvania Liquor Control
Board (PLCB). Although the Pennsylvania State Police, Bureau of Liquor
Control Enforcement, enforces these laws and regulations, the PLCB is
responsible for establishing the regulations and issuing “legal
interpretations” of the Liquor Code.
The PNA's Legal Hotline receives a number of questions about
liquor-related advertising each year, from whether prices can be included in
an ad (they can), to whether a bar can hold a ladies' night giving women
special prices (it cannot). In the materials below, we have attempted to
gather our resource materials related to the advertising of alcoholic
beverages in Pennsylvania. The Pennsylvania Liquor Control Board has also
recently prepared a guidance document on this issue for media entities.
