Q: We received an ad looking for surrogates. Can we run it?

A: There is no Pennsylvania law that specifically addresses surrogacy. There are, however, Pennsylvania adoption laws that limit the types of fees that can be paid in an adoption. It is also a crime to buy or sell babies. An ad seeking surrogate mothers would not be unlawful. However, ads promising certain “fees” or “payments” made to the surrogates could raise legal issues.
